Terms of Service

These Terms of Service ("Terms") govern your access to and use of Burnbreaker (the "Service"), operated by Burnbreaker ("we", "us"), based in Sweden. You can contact us at support@burnbreaker.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

Burnbreaker is a proxy that sits between your application and third-party Large Language Model ("LLM") providers (such as Anthropic and OpenAI) and lets you set spending limits ("caps") on LLM API usage on a per-run basis. The Service attempts to block API calls that would exceed a cap you configure.

2. The Service is a tool, not a guarantee

You are solely responsible for monitoring and controlling your own LLM provider spending. Burnbreaker is a safety mechanism intended to help you reduce the risk of runaway costs. It is not a guarantee that your spending will never exceed any amount, and it is not a substitute for your own budget controls, provider-side limits, and monitoring.

You acknowledge that:

• You bring your own LLM provider API keys; your token/usage costs are billed directly to you by your provider (e.g. Anthropic, OpenAI). Burnbreaker does not pay, hold, route around, or reimburse those provider charges.
• Software can fail. Outages, bugs, network issues, provider changes, misconfiguration, or events outside our control may cause caps not to be enforced as intended.
• You remain responsible for any and all charges incurred with your LLM providers, whether or not a cap was enforced.

3. Accounts

You must provide accurate information and keep your credentials (including gateway keys) secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to: misuse or attempt to disrupt the Service; reverse engineer or attempt to extract source code except as permitted by law; use the Service for unlawful purposes; or attempt to circumvent usage limits, security, or access controls.

5. Plans, fees, and billing

Paid plans are billed in advance on a recurring (monthly) basis through our payment processor (Stripe). Fees are stated on our pricing page. Your LLM provider costs are separate and are not part of, or affected by, Burnbreaker's fees. You can cancel at any time; cancellation stops future renewals. Except where required by law, fees already paid are non-refundable. We may change pricing with reasonable notice; changes apply to subsequent billing periods.

6. Free tier

Free-tier usage is subject to the limits stated on our pricing page and may be changed or discontinued. Free tier is provided with no warranties of any kind.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SPENDING CAPS WILL ALWAYS BE ENFORCED.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, OR FOR ANY LLM PROVIDER CHARGES, COSTS, OR OVERAGES, WHETHER OR NOT A SPENDING CAP WAS ENFORCED, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) EUR 50.

Nothing in these Terms limits liability that cannot be limited under applicable mandatory law (for example, liability for intentional misconduct, gross negligence, or, for consumers, statutory rights that cannot be waived).

9. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right (including your agreements with your LLM providers).

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will survive.

11. Changes to these Terms

We may update these Terms. Material changes will be communicated by reasonable means (e.g. notice on the site or by email). Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Sweden, without regard to conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the courts of Sweden, except where mandatory consumer-protection law provides otherwise.
